These Terms and Conditions ("T&C") constitute a legally binding agreement established by the Ridge Grove Estates Homeowners Association ("HOA," "we," "us," or "our"). These T&C set forth the legal boundaries governing the activities of all members, residents, and visitors ("you" or "your") within the Ridge Grove Estates community, including interactions with HOA property, services, and any digital platforms maintained by the HOA (e.g., website, portal). By becoming a member of the Ridge Grove Estates HOA, residing within Ridge Grove Estates, or otherwise interacting with the HOA's property or services, you acknowledge that you have read, understood, and agree to be bound by these T&C. These T&C are designed to establish the legal relationship between you and the Ridge Grove Estates HOA.

3. Scope and Applicability

These T&C are defined according to the specific needs and nature of the Ridge Grove Estates HOA. They govern, but are not limited to, the use of common areas, adherence to community rules and regulations, payment of assessments, maintenance of property, and participation in HOA-related activities. These T&C provide the Ridge Grove Estates HOA with the ability to manage the community effectively, maintain property values, and protect itself from potential legal exposure, subject to applicable laws and jurisdiction.

4. What These T&C Include

Generally speaking, these T&C address the following types of issues, among others:

  • Who is Allowed to Use HOA Facilities and Services: Defining eligibility for using common areas, amenities, and participating in HOA programs.

  • HOA Assessments and Payment Methods: Outlining the schedule, methods, and obligations for the payment of HOA assessments, fees, and other charges.

  • Changes to HOA Offerings and Rules: A declaration that the HOA may modify, add, or discontinue services, amenities, rules, or regulations in the future, with appropriate notice to members.

  • Warranties and Disclaimers: Clarification regarding any warranties provided by the HOA (e.g., regarding common area maintenance) and disclaimers of liability where applicable.

  • Intellectual Property and Copyrights: Where relevant, addressing issues of intellectual property or copyrights pertaining to HOA-generated content, documents, or digital platforms.

  • Member Conduct and Responsibilities: Establishing guidelines for respectful and responsible conduct within the community, adherence to governing documents (e.g., Covenants, Conditions, and Restrictions - CCRs, Bylaws), and maintenance of individual properties.

  • HOA's Right to Suspend or Restrict Privileges: The HOA's right to suspend or restrict a member's access to certain amenities or services, or impose fines, for violations of these T&C or other governing documents.

  • Dispute Resolution: Procedures for resolving disputes between members and the HOA.

  • Privacy Policy Reference: A reference to the HOA's Privacy Policy (if applicable), outlining how personal information is collected, used, and protected.

  • Indemnification: Provisions regarding indemnification of the HOA by members for certain actions or omissions.

  • Governing Law: The jurisdiction whose laws will govern these T&C.

  • Severability: A statement that if any provision of these T&C is found to be unenforceable, the remaining provisions will remain in effect.

5. Amendments to These Terms & Conditions

The Ridge Grove Estates HOA reserves the right to modify or update these T&C at any time, in its sole discretion. Any changes will be effective immediately upon posting the revised T&C on the HOA's official communication channels (e.g., website, notice boards, direct communication). It is your responsibility to review these T&C periodically for updates. Your continued membership, residency, or interaction with the Ridge Grove Estates community following the posting of revised T&C signifies your acceptance of those changes.
